These Terms & Conditions (the “Terms”) govern your access to and use of Club Scene — our website and progressive web app (together, the “Platform”). The Platform is operated by Club Scene (“we”, “us”, or “our”).

By accessing, browsing, or creating an account on the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.

• User / you — any person who accesses the Platform, with or without an account.
• Venue — a nightlife establishment listed on the Platform, operated by an independent third party.
• Venue Admin— a person authorised to manage a Venue's profile and events on the Platform.
• Event— a nightlife event listed on the Platform, whether hosted at a Venue or as a standalone (“open”) event.
• Content — any information, text, images, listings, lineups, prices, ratings, or other material made available on the Platform.

The Platform lists nightlife events, many of which are restricted to persons 18 years or older and may involve licensed premises serving alcohol. By using the Platform, you confirm that you are at least 18 years old, or the applicable minimum age for the events you view, and that you have the legal capacity to accept these Terms.

The Platform is not directed at children. Admission to any Event is subject to the age policy set by the Venue or organiser, which may differ from and override any age information shown on the Platform.

Club Scene is a discovery platform. We help you find nightlife events and venues near you — showing lineups, set times, door prices, dress codes, and links out to tickets or directions. Browsing is free and does not require an account. An account is only needed for actions that save data to your profile, such as favourites, “I'm going”, and ratings.

We are an information and discovery service only. We do not sell tickets, process admissions, take bookings, or handle payments for any Event.

Except where a listing is expressly identified as operated by Club Scene, we do not own, operate, control, endorse, host, or organise any Venue or Event listed on the Platform. Venues and Events are owned and run by independent third parties. Listings are created and maintained either by those Venues (through their Venue Admins) or compiled by us from publicly available information for discovery purposes.

Accordingly:

• We do not guarantee the accuracy, completeness, or timeliness of any listing — including lineups, set times, prices, age restrictions, dress codes, or whether an Event will proceed, be changed, or be cancelled.
• Any contract for entry, tickets, tables, or services is between you and the Venue or organiser. We are not a party to that arrangement and have no responsibility for it.
• Admission, refunds, safety, conduct on the premises, and compliance with the law at any Event are the sole responsibility of the Venue or organiser.
• The use of a Venue's name, logo, or branding on the Platform is for identification and discovery only and does not imply any partnership or endorsement unless we state so.
• Images and media shown on listings — such as venue photos, event banners, artwork, and lineup images — belong to the relevant Venue, organiser, or their licensors, not to us. We display them only for discovery, and we will remove any such image promptly on a valid request from its rights holder (see section 11).

Always confirm the essential details (date, price, age policy, and whether the Event is going ahead) directly with the Venue or organiser before you travel.

To use features that write to your profile you must create an account using email and password or Google sign-in. You agree to provide accurate information, to keep your login credentials confidential, and to be responsible for all activity that occurs under your account. Notify us promptly at info@club-scene.co.za if you suspect unauthorised use.

Your username is public and shown alongside content such as ratings. Do not choose a username that impersonates another person or is offensive.

You agree not to:

• use the Platform for any unlawful, fraudulent, or harmful purpose;
• post false, misleading, defamatory, abusive, or infringing Content, or submit ratings you are not entitled to give;
• scrape, harvest, or systematically extract data from the Platform, or use it to build a competing dataset, without our written permission;
• attempt to gain unauthorised access to the Platform, other accounts, or our systems, or interfere with the Platform's security or operation;
• misrepresent your affiliation with any Venue or attempt to manage a Venue you are not authorised to manage.

Some features let you contribute Content, such as marking “I'm going” and rating events or venues. Ratings for an Event are limited to users who marked attendance and only become available after the Event has ended. You are responsible for the Content you submit and confirm you have the right to submit it.

By submitting Content you grant us a non-exclusive, royalty-free licence to host, display, and use it for the purpose of operating and promoting the Platform. We may remove or moderate any Content that we reasonably believe breaches these Terms, without notice.

The Platform links out to third-party services — for example ticketing providers, and map or ride-hailing apps for directions. These links are provided for convenience only. We do not control and are not responsible for third-party websites, services, pricing, or their handling of your information. Your use of them is governed by their own terms and policies.

The Platform can use your device's location to show events and venues near you, with your permission. Location and distance results are approximate and provided for convenience; we do not guarantee their accuracy. You can decline or revoke location access at any time in your device or browser settings and instead browse by city. How we handle location data is described in our Privacy Policy.

The Platform, its design, branding, and underlying software are owned by us or our licensors and are protected by intellectual-property laws. You may use the Platform for your personal, non-commercial discovery of nightlife. All other rights are reserved. Venue and organiser names, logos, and artwork remain the property of their respective owners.

We do not claim ownership of the images and media uploaded for venues and events. Those files remain the property of the Venue, organiser, or other rights holder who provided them, and are hosted by us only to power the listing. If you are the rights holder of an image and want it removed, email info@club-scene.co.za — we will take it down promptly once we can reasonably verify your request. Venue Admins can also remove media from their own listings at any time.

The Platform and all Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted or error-free, or that any listing is accurate or current.

You attend events and travel to venues at your own risk. We are not responsible for what happens at any Event or Venue, including cancellations, changes, refused entry, or any loss or harm suffered there.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, data, or opportunity, arising from your use of (or inability to use) the Platform or your dealings with any Venue or organiser. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law of the Republic of South Africa.

You agree to indemnify and hold us harmless from any claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or Content you submit.

We may suspend or terminate your access to the Platform, or remove Content, if you breach these Terms or where reasonably necessary to protect the Platform or other users. You may stop using the Platform and request deletion of your account at any time by contacting info@club-scene.co.za.

We may update the Platform and these Terms from time to time. When we make material changes we will update the “last updated” date above and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of its courts. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
